Atomic Energy Control Legislation - United States Enquiry

There is attached for your signature, if you
concur,
letters addressed to the Chairmau, Chiefs of Staff
and the Secretary to the Cabinet concerning the United
States enquiry about Canadian legislation which prohibits
the storage of nuclear weapon components in Canada. There
has been considerable correspondence, in which this Department has been involved, concerning the application of paragraph 201 of the Atomic Energy Control Regulations (PC 19541643) which provides that "No person shall import into
Canada or export from Canada any prescribed equipment • . .
or any prescribed substance without first producing for the
Collector of Customs and Excise in the proposed port of
entry or exit an import or export permit from the Board* . .'
At first reading this regulation would not seem to prohibit
the import of prescribed material (i.e. any substance containing radioactive elements or isotopes) but simply
requires import or export permits. We have not raised this
question in the letter proposed for your signature because
we would wish to have a more thorough examination of the
relevant legislation made (and incidentally because the
Minister of National Defence has evidently used the word
"prohibit"). We shall be asking Legal Division for an
opinion on the legislation in question.

Whatever the outcome of an investigation of
the current legislation may be, we believe this Department
should recommend, as we do in the attached letter, that as
forthcoming an attitude as possible be taken towards the

American enquiry. The State Department has done its best in
the past to keep us informed of the plans and progress of the
United States Government in revising United States atomic
legislation. We are not certain why the United States enquiry
has been made but it may be that it is part of the process of
examination by the United States authorities of the problems
involved in making nuclear weapons available to their allies.
