Reference is made to a conversation on April 16 between Mr. Robert Cameron, Defence liaison Division 1, Department of External Affairs, and an officer of this Embassy regarding the possibility of negotiating a new multilateral KATO Agreement on Cooperation Regarding Atomic Information which would be designed to expand the categories of information transmitted beyond those provided for in the existing Agreement. As the Canadian Government is aware, Article I of the present NATO Agreement on Cooperation Regarding Atomic Information, signed at Paris on June 22, 1955* is based on Section 144 b of the United States Atomic Energy Act of 1954* This Act prohibited the transfer of any information important to the design and fabrica«tion of atomic weapons. The Act of July 2, 1958 amended Section 144 b to remove this prohibition and established new categories of information. A new NATO agreement would be necessary for the transfer of information relating to the new categories. In drafting any new agreement, it would be made clear that there would be no question of superseding the present Agreement until the new agreement should come into force. To avoid possible confusion, it should be stated that certain bilateral agreements have been negotiated under Section 144 b which have differing aims from the proposed multilateral agreement* The bilateral 144 b agreements provide for the transmission of SECRET 000199 �Document disclosed under the Access to Information Act Document divulgue en vertu de la Loi sur Tacces a Tinformation BEST AVAILABLE COPY SECRET - 2 - information to national representatives for national purposes, such as training, and do not provide for the transmission of atomic energy information to international military headquarters. The NATO multilateral 144 b agreement would make possible the .transmission of such information to NATO Military Headquarters for NATO planning purposes. The United States expects shortly to propose in NATO a new NATO multilateral agreement along the same lines as the present Agreement to meet the changed situation resulting from the amendments of the Atomic Energy Act of 1954 a^d hopes that the Government of Canada might be prepared to cooperate in the negotiation of such an agreement.
