Dear Mr. Heeney: Further to your letter of today’s date and confirming our telephone conversation I have discussed this matter with Mr. Claxton and am forwarding herewith a suggested rewrite of Appendix ”0”, in duplicate, which has been agreed to by Mr. Claxton. It is understood that this will be reviewed again on the return of Mr. Pearson from Washington. In the meantime the Judge Advocate General is checking to see whether under the Aeronautics Act the Minister of National Defence has authority to regulate flights of military aircraft over Canada, including United States aircraft, without requiring a special Order-in-Council. I expect to have a report on this by the time Mr. Pearson returns from Washington. I have also suggested to Mr. Claxton that in my opinion it is now time that this whole question of atomic flights should be discussed at Cabinet Defence Committee.
