MEMORANDUM TO THE CABINET;
MB-1 Overflight Agreement
It will be recalled that by an Exchange of
Notes of June 30, 1959 United States aircraft under
the operational control of NORAD are authorized to
carry nuclear air-to-air defence weapons over Canada
under certain conditions. One of these conditions
is that the aircraft may enter Canadian air space
only whenever a condition of"air defence readiness"or
a higher state of alert is declared by CINCNORAD.
These would only be declared in a situation of grave
emergency when an attack on North America is deemed
to be either imminent or actually in progress.
The Exchange of Notes provides that the
authorization shall continue in force for a one-year
period at a time. It has been renewed annually ever
since. The Agreement will, however, lapse automatically
at midnight, on June 30 next, unless it is renewed.
Officials of the Departments of External
Affairs and of National Defence have reviewed this
Agreement and consider that one non-substantive
modification is required. NORAD no longer employs the
term "air defence readiness", employing instead the
term "Defence Condition 1 (DEFCON l)« which is its
equivalent.

The Secretary of State for External Affairs,
with the concurrence of the Minister of National Defence,
recommends that the Gabinet approve an extension ©f
the authorization obtained in this Agreement for a

further one-year period and that the Canadian Ambassador
to the United States be authorized to submit to the
Department of State a Note, a draft of which is attached,
to this effect, and at the same time proposing the
above amendment.
