Dear Mr* Sellers:
We spoke on the telephone not long ago
about your request to Mr. Menzlea for additional
Information concerning the regulatory powers available
to tbe Canadian Government to control entry to Canada,
and movement within Canadian territory or territorial
waters, of nuclear materials and equipment.
As I explained, there are really three
different forma of authority under which the Government
may control such activities*

A wide range of activities involving nuclear
energy m one way or another requires authorisation by
tbe Atomic Energy Control Board in accordance with the
provisions of the Atomic Energy Control Act and the
Atomic Energy Control Regulations (copies attached).

In a second category, movement of materials
or equipment relating to nuclear energy into or out of
Canadian territory is governed by various provisions of
the Export and Import permits Act and of Regulations
issued under the authority of that Act. Copies of these
documents are also attached.
Finally, there la an inter-departmental body
known as the Suclear Vessels control Co-ordinating Committee, chaired at present by Hr. Cumyn of the Department

of Transport. As I understand It, the function of this
Committee is to advise the Minister of Transport concerning the movement of nuclear-powered or nucleararmed vessels into or within Canadian territory. While
I am afraid I do not have copies of the relevant legislation available, and indeed am not familiar with it
in detail, I would assume that legislation exists under
which the Minister of Transport, acting either in bis
own name or through such governmental agencies as tbe
National Harbours Board, may regulate the movement of
ships or aircraft Into and within Canadian territory.
X would assume also that in exercising this authority
with regard to nuclear-powered or nuclear-armed vessels
the Minister would normally act on the advice of the
Committee I have mentioned.
