We have reviewed a number of files dealing with various aspects of tbe question of introduction of nuclear ueapona into Canada but have been unable to locate any reference at all to the oatter of damage claims arising from nuclear accidents. The possibility of accident ess taken into account during the 1956-57 negotiation of the "HB-l Agreement *, but the agreement contains no provision for tbe handling of possible claims* It merely outlines safety measures and procedures for reporting crashes and conducting salvage operations , as follows: "(4) Tbe United States Government has taken the utmost precaution in designing the weapon, and Mill exercise equal precaution in establishing operational procedures, to insure a minimum possibility of public hazard when employment of the KB-1 Is necessary. Representatives of the Royal Canadian Air Force have been thoroughly informed by tbe United States Air Force concerning safety features. "(5) In accordance with current agreed procedures, crashes of aircraft from either country in the territory of the other are reported on a service-to-service basis. During the term of this agreement the United States will take measures to insure that the Canadian Government is immediately notified of any crash in Canadian territory of a United States aircraft carrying HB-1 rockets. . . . / 2 000629 �Document disclosed under the Access to Information Act Document divulgue**ngjeQu de ]g Lqi sur I'acces a I'information - 2 "(6) Detailed arrangements will be made between the United States Air Force and the Royal Canadian Air Force to provide designated RCAF personnel with training necessary for the salvage of MB-1 weapons following an accident. In the event salvage is necessary, the United States Air Force is willing to send at any time, upon request, trained personnel to assist in the operation.B 2. Although we have not checked every possible file (dozens of volumes are involved) we have examined the apparently most relevant and are satisfied that if provision for damage claims has ever been made we would have found some reference to it. Consequently we share your belief that no such provision exists in the various bilateral agreements with the United States concerning nuclear weapons.
