On November 28, 1963, Cabinet decided that Canada would not adhere to the Brussels Convention on liability of operators, of nuclear ships, and the Vienna Convention on civil liability for nuclear damage. Instead 'it was agreed that we should explore with the U.S.A. the possibility of entering into a bilateral agreement covering substantially the subject matter of the Brussels and Vienna Conventions. 2. . Recently the Interdepartmental Committee ,. on nuclear hazard insurance met to consider what, from a Canadian point of view, the content of such an agreement might be. During the discussion the question arose concerning possible damage in Canada by SAC aircraft carrying nuclear weapons or by U.S. logistic aircraft carrying nuclear warheads to Europe through Canada or to Canada for use by Canadian forces. It was the consensus of the Committee that the agreement contemplated would be directed at "peaceful uses". It was assumed that the question of nuclear damage falling out of an accident involving U.S. aircraft, in Canada, would already be covered in existing agreements. .With reference to the Interdepartmental Committee's further study of a possible bilateral agreement with the U.S.A,, covering liability for damage resulting from a nuclear accident, this Department's representative was asked to look into the question. CIRCULATION 3« Could you inform us whether any stipulation was made regarding claims for damages in the "negotiation^" of the SAC overflight arrangements. If not, we would presume that the applicable provision would be Article VIII of the North Atlantic Treaty Status of Forces Agreement CTS 1953/l5> under which, Canada would be responsible for 25 percent of the amount of the claim.
