Meeting of November 2gth, 1963

Civil liability for nuclear damage;
need for domestic legislation and
for a treaty with the U.S.
The Cabinet approved the recommendations
of the Minister of Finance, which had been supported
by the Cabinet Committee on Economic Policy, Trade •
and Employment,(a)

that the conclusions concerning the
1962 Brussels Convention on Liability of
Operators of Nuclear Ships and the 1963
Vienna Convention on Civil Liability for
Nuclear Damage, set out in Appendices A
and B to the Minister's memorandum of
October 1st (Cab. Doc. 313-63), be
noted and endorsed;

(b)

that Canada should not become party to
either Convention at the present time but
should continue to work towards their
improvement, or possibly their
replacement by viable international
Instruments;

-(c)

that Canada should explore with U.S.
authorities their possible interest in
concluding a bilateral treaty at some
future date, dealing with liability and
indemnity arrangements insofar as the
development of the nuclear industry in
one country affects the interest of
residents in the other; and

(d)

that the principles set out in
Appendix C to the Minister's memorandum
of October 1st be approved as a basis
for draft legislation to be prepared for
submission to Cabinet at a later date.
