The two Governments recognize the limitations of the United States Atomic Energy Act regarding the transfer of nuclear weapons. The President will take such steps as may be necessary, acting within his Constitutional powers as Commander-in-Chief to authorize military action in emergencies, to make nuclear weapons available for employment by Canadian units under the operational control of CINCNORAD in emergency circumstances or upon the Declaration of Defense Condition 1 or higher state of readiness. Similarly, the Prime Minister shall take such steps as may be necessary to authorize United States units equipped with nuclear weapons to be employed under the operational, control of CINCNORAD in Canadian territory, including its air space, under the emergency circumstances or upon the Declaration of Defense Condition 1 or higher state of readiness.
