A u s s i longtemps que 1'Organisation du Traite* de l'Atlantique Nord a p p o r t e r a des contributions s u b s t a n t i e l l e s et m a t e r i e l l e s aux efforts communs de defense, le Gouvernement des E t a t s - U n i s d1 Ame"rique m e t t r a de t e m p s a. a u t r e a. la disposition de cette O r g a n i s a t i o n , y c o m p r i s de s e s o r g a n i s m e s civils et m i l i t a i r e s et de ses c o m m a n d e m e n t s m i l i t a i r e s , des r e n s e i g n e m e n t s a t o m i ques que le Gouvernement des E t a t s - U n i s d' A m e r i q u e j u g e r a n e c e s s a i r e s pour: (a) 1'elaboration des plans de defense; (b) 1'entraihement du p e r s o n n e l a 1'emploi a r m e s atomiques et a. la defense contre armes; des ces (c) 1'Evaluation du potentiel d ' e n n e m i s eVentuels en ce qui concerne 1'emploi des a r m e s atomiques . �A G R E E M E N T B E T W E E N THE PARTIES TO THE NORTH ATLANTIC TREATY FOR CO-OPERATION REGARDING ATOMIC INFORMATION PREAMBLE The P a r t i e s to the North Atlantic T r e a t y , signed at Washington on 4th A p r i l , 1949, Recognising that their mutual s e c u r i t y r e q u i r e s that they be p r e p a r e d to m e e t the of atomic w a r f a r e , and and defence contingencies Recognising that t h e i r common i n t e r e s t s will be advanced by making available to the North Atlantic T r e a t y Organization information pertinent t h e r e t o , and Taking into c o n s i d e r a t i o n the United States Atomic E n e r g y Act of 1954, which was p r e p a r e d with these p u r p o s e s in mind, Acting on t h e i r own behalf and on behalf of the North Atlantic T r e a t y Organization, A g r e e as follows: ARTICLE I t 1 :' While the North -Atlantic T r e a t y Organization continues to make substantial and m a t e r i a l contributions to the common defence efforts, the United States will from t i m e to time make available to the North Atlantic T r e a t y Organization, including its civil and military agencies and c o m m a n d s , atomic information which the Government of the United States of A m e r i c a deems n e c e s s a r y to: (a) the development of defence plans; (b) the training of p e r s o n n e l in the employment of and defence against atomic weapons; and (c) the evaluation of the capabilities of potential enemies in the employment of a t o m i c weapons. r �- 3 - 2 . Au sens ou il est utilise dans le p r e s e n t A c c o r d , et dans la m e s u r e ou il concerne les r e n s e i g n e m e n t s fournis par les E t a t s - U n i s , le t e r m e " r e n s e i g n e m e n t s atomiques" signifie les renseignements faisant l'objet d'une diffusion r e s t r e i n t e , tels qu'ils sont definis a la Section 11 r de la Loi a m e r i c a i n e de 1954 sur l ' E n e r gie Atomique dont la communication est a u t o r i s e e aux t e r m e s des dispositions de la Section 144 b de cette Loi, ainsi que les r e n s e i g n e m e n t s concernant p r i n c i p a lement l'utilisation m i l i t a i r e des a r m e s a t o m i q u e s , qui ont ete r e t i r e s de la categorie des r e n s e i g n e m e n t s faisant l'objet d'une diffusion r e s t r e i n t e conformement aux dispositions de la Section 142 d de la Loi a m e r i c a i n e de 1954 sur l ' E n e r g i e Atomique. 3 . Toute communication p a r le Gouvernement des E t a t s - U n i s d'Amerique de r e n s e i g n e m e n t s atomiques s'effectuera conformement aux dispositions de la Loi a m e r i c a i n e de 1954 sur l ' E n e r g i e Atomique et des lois a m e r i c a i n e s u l t e r i e u r e s sur cette question. En vertu de cet A c c o r d , il ne s e r a fait aucun t r a n s f e r t d' a r m e s atomiques ni de m a t e r i e l n u c i e a i r e special, au sens ou ils sont definis aux Sections 11 d et 11 t de la Loi americaine de 1954 sur l ' E n e r g i e Atomique. (Les t e x t e s des Sections de la Loi a m e r i c a i n e de 1954 sur l'Energie Atomique vises aux p a r a g r a p h e s 2 et 3 c i d e s s u s sont r e p r i s en Annexe au P r e s e n t A c c o r d ) . ARTICLE II i . Les renseignements atomiques communiques a. l'Organisation du T r a i t e de l'Atlantique Nord s e r o n t t r a n s m i s par les voies u t i l i s e e s actuellement pour la communication a. l'Organisation du Traite" de l ' A t l a n t i que Nord de r e n s e i g n e m e n t s m i l i t a i r e s a s s o r t i s d'une classification de s e c u r i t e . 2 . Seront seuls a u t o r i s e s a. r e c e v o i r d i r e c t e m e n t des r e n s e i g n e m e n t s atomiques les m e m b r e s du p e r s o n n e l de l'Organisation du T r a i t e de l'Atlantique Nord qui , en r a i s o n de l e u r s fonctions, doivent y avoir a c c e s . Aucvne diffusion de ces renseignements ne p o u r r a e t r e faite a l'inte"rieur de l'Organisation, si ce n ' e s t aux seules p e r sonnes obligees de les c o n n a i t r e en r a i s o n des r e s p o n sabilites qui leur incombent au sein de 1' Organisation du T r a i t s de l'Atlantique Nord. Ces r e n s e i g n e m e n t s ne seront communiques p a r l'Organisation du T r a i t e de l'Atlantique Nord ni a. des p e r s o n n e s non a u t o r i s e e s , ni �- 4 - 2. As used in this Agreement so far as concerns information provided by the United S t a t e s , "atomic information" m e a n s R e s t r i c t e d Data, as d e f i n e d in Section 11 r of the United States Atomic E n e r g y Act of 1954, which is p e r m i t t e d to be communicated pursuant to the provisions of Section 144 b of that Act, and information relating p r i m a r i l y to the m i l i t a r y utilisation of atomic weapons which has been r e m o v e d from the R e s t r i c t e d Data category in a c c o r d a n c e with the p r o visions of Section 142 d of the United States Atomic Energy Act of 1954. 3 . All t r a n s f e r s by the Government of the United States of A m e r i c a of atomic information will be made in compliance with the provisions of the United States Atomic E n e r g y Act of 1954, and subsequent applicable United States legislation. Under this A g r e e m e n t t h e r e will be no t r a n s f e r s of atomic weapons or special nuc l e a r m a t e r i a l , as these t e r m s a r e defined in Sect i o n 11 d and Section 11 t of the United States Atomic Energy Act of 1954. (The Sections of the United States Atomic E n e r g y Act of 1954 r e f e r r e d to in p a r a g r a p h s 2 and 3 of this A r t i c l e a r e attached). ARTICLE II 1. Atomic information which is t r a n s f e r r e d to the North Atlantic T r e a t y Organization will be made a v a i lable through the channels now existing for provid i n g classified m i l i t a r y information to the North Atlantic T r e a t y Organization. 2 . Only those p e r s o n s within the North A t l a n t i c T r e a t y Organization whose duties r e q u i r e a c c e s s t o atomic information m a y be the original r e c i p i e n t s of such information. Atomic information will be author i s e d for dissemination within the North Atlantic T r e a t y Organization only to p e r s o n s whose No r t h Atlantic Treaty Organization responsibilities r e q u i r e them to have a c c e s s to such information. Information will not be t r a n s f e r r e d by the North Atlantic Treaty O r g a n i z a t i o n to unauthorised �- 5 - h o r s du domaine ou s'exerce son aatorite. Le Gouvernement des Etats-Unis d'Amerique pourra stipuler dans quelle mesure l'une des categories de renseignements qu'ils auront fournis pourra etre communiqu^e et specifier la categorie de personnes qui pourront avoir acces a ces renseignements et imposer telles autres restric tions qu'ils jugeront necessaires en ce qui concerne la diffusion de ces renseignements. ARTICLE IH 1. Les renseignements atomiques beneficieront de toute la protection de securite prevue par les reglements et procedures de securite de l'Organisation du Traite de l'Atlantique Nord et par les lois et reglements nationaux applicables a ces renseignements. En aucun cas, les de~ tenteurs de ces renseignements ne leur appliqueront des normes de securite inferieures a celles qui sont stipulees dans les reglements de securite appropries de l'Organisation du Traite de l'Atlantique Nord ayant effet a la date ou le present Accord entrera en vigueur. ARTICLE IV 1. Les renseignements atomiques communiques par le Gouvernement des Etats-Unis d'Amerique conformement a l'Article Premier du present Accord seront utilises exclusivement pour la preparation et 1*execution des plans de defense de l'Organisation du Traite de 1* Atlantique Nord. 2. L'Organisation du Traite de l'Atlantique Nord communiquera de temps a autre des rapports au Gouvernement des Etats-Unis d'Amerique sur l'usage qui aura ete fait de ces renseignements. Ces rapports fourniront les precisions demandees par le Gouvernement des EtatsUnis d'Amerique et contiendront en particulier une liste des personnes en possession de certaines categories de renseignements conformement aux dispositions du paragraphe 2 de l'Article II, et une liste des documents communiques. �- 6 p e r s o n s or beyond the jurisdiction of that Organization . The Government of the United States of A m e r i c a may stipulate the degree to which any of the c a t e g o r i e s of information made available by it m a y be d i s s e m i n a t e d , may specify the c a t e g o r i e s of p e r s o n s who m a y have a c c e s s to such information, and m a y impose such other r e s t r i c t i o n s on the dissemination of information as it deems n e c e s s a r y . ARTICLE IH 1. Atomic information will be accorded full s e c u r i t y protection under applicable N o r t h A t l a n t i c T r e a t y Organization regulations and p r o c e d u r e s , and where applicable, national legislation and r e g u l a t i o n s . In no c a s e will recipients maintain s e c u r i t y standards for the safeguarding of atomic information lower than those set forth in the pertinent N o r t h A t l a n t i c Treaty O r g a n i z a t i o n security regulations in effect on the date this A g r e e m e n t Comes into force . ARTICLE IV 1. Atomic information which is t r a n s f e r r e d by the Government of the United States of A m e r i c a p u r s u a n t to Article I of this A g r e e m e n t shall be used exclusively for the p r e p a r a t i o n of and in implementation of North Atlantic Treaty O r g a n i z a t i o n defence p l a n s . 2. The North A t l a n t i c T r e a t y Organizat i o n will from time to time r e n d e r r e p o r t s to the Government of the United States of A m e r i c a of the use which has been m a d e of the information. These r e p o r t s will contain pertinent information r e q u e s t e d by the Government of the United States of A m e r i c a and will in p a r t i c u l a r contain a l i s t of the p e r s o n s p o s sessing c e r t a i n c a t e g o r i e s of information, in accordance with the provisions of p a r a g r a p h 2 of A r t i c l e II, and a l i s t of the documents which have been transferred. �- 7 - ARTICLE V 1. Les Etats P a r t i e s au T r a i t e de l'Atlantique Nord a u t r e s que les E t a t s - U n i s m e t t r o n t a la disposition de l'Organisation du T r a i t e de l'Atlantique N o r d , dans la m e s u r e ou elles le jugeront n e c e s s a i r e , l e s r e n s e i g n e ments qui entreront dans les m e m e s c a t e g o r i e s que ceux communiques par les E t a t s - U n i s aux t e r m e s de l ' A r t i c l e I du p r e s e n t A c c o r d . La communication de ces r e n s e i gnements s'effectuera dans des conditions identiques ou equivalentes a celles prevues par le p r e s e n t A c c o r d pour les renseignements communiques p a r les E t a t s - U n i s . ARTICLE VI 1 . Le les Etats notifie au sont lies p r e s e n t A c c o r d e n t r e r a en vigueur des que tous P a r t i e s au T r a i t e de l'Atlantique Nord auront Gouvernement des E t a t s - U n i s d'Amerique qu'ils par les t e r m e s du p r e s e n t A c c o r d . 2 . Si un Etat accede au T r a i t e de l'Atlantique Nord, aucun r e n s e i g n e m e n t t r a n s m i s a. l'Organisation du T r a i t e de l'Atlantique Nord en v e r t u du p r e s e n t A c c o r d ne s e r a communique a un r e s s o r t i s s a n t quelconque du nouveau m e m b r e de l'Organisation du T r a i t e de l'Atlantique Nord ou a toute personne employee par ce nouveau m e m b r e , avant que le gouvernement de c e l u i - c i n ' a i t notifie au Gouvernement des E t a t s - U n i s d'Amerique qu'il se trouve lie par l e s t e r m e s du p r e s e n t Accord; des cette notification, le p r e s e n t Accord e n t r e r a en vigueur en ce qui concerne le nouveau m e m b r e . 3 . Le Gouvernement des E t a t s - U n i s d'Amerique inf o r m e r a tous les Etats P a r t i e s au T r a i t e de 1'Atlantique Nord de I ' e n t r e e en vigueur du p r e s e n t A c c o r d prevue au p a r a g r a p h e 1 du p r e s e n t A r t i c l e , et de chaque notification r e c u e , conformement au p a r a g r a p h e 2 du p r e s e n t Article. 4 . Le p r e s e n t Accord r e s t e r a en vigueur a u s s i longtemps que le T r a i t e de l'Atlantique Nord l u i - m g m e . En foi membres ont signe respectifs de quoi, les R e p r e s e n t a n t s sous signe s des Etats de l'Organisation du T r a i t e de l'Atlantique Nord le p r e s e n t Accord tant au nom de l e u r s Etats qu'au nom de l ' O r g a n i s a t i o n . �ARTICLE V 1. The P a r t i e s to the North Atlantic T r e a t y , other than the United S t a t e s , will to the extent that they deem n e c e s s a r y , make available to the North Atlantic T r e a t y Organization information in the same categories as m a y be made available by the United States under A r t i c l e I of this A g r e e m e n t . Any such information will be supplied on the s a m e or s i m i l a r conditions as those which apply under this A g r e e m e n t with r e s p e c t to the United S t a t e s . ARTICLE VI 1 . The A g r e e m e n t shall enter into force upon notification to the United States by all P a r t i e s to the North Atlantic T r e a t y that they a r e bound by the t e r m s of the A g r e e m e n t . 2 . If any other State becomes a P a r t y to the North Atlantic T r e a t y no information made available to the North Atlantic T r e a t y Organization under this A g r e e m e n t will be provided to any p e r s o n who is a national of, or who is employed by, the new P a r t y to the North Atlantic T r e a t y until the new P a r t y has notified the Government of the United States of A m e r i c a that it is bound by the t e r m s of this A g r e e m e n t , and upon such notification, this A g r e e m e n t will enter into force for the new P a r t y . 3 . The Government of the United States of America will inform all P a r t i e s to the North Atlantic T r e a t y of the entry into force of this A g r e e m e n t under p a r a g r a p h 1 of this A r t i c l e and of each notification r e c e i v e d under p a r a g r a p h 2 of this A r t i c l e . 4 . This A g r e e m e n t shall be valid a s long as the North Atlantic T r e a t y is in f o r c e . In witness whereof the undersigned have signed the p r e s e n t Agreement on respective S t a t e s , m e m b e r s of the North Organization, and on behalf of the North Organization. "Atomic weapon" Section 11 r: " r . The t e r m ' R e s t r i c t e d Data 1 means a l l d a t a concerning: ( 1 ) design, m a n u f a c t u r e , or u t i lisation of a t o m i c weapons; ( 2 ) the production of special n u c l e a r m a t e r i a l ; or (3) the u s e of s p e cial n u c l e a r m a t e r i a l in the p r o duction of e n e r g y , but shall not include data declassified o r r e moved from the Restricted D a t a c a t e g o r y p u r s u a n t to Section 1 4 2 " .
