Atomic Enerrtv Control Legislation - United States Enquiry
1.
V/ith reference to your letter of 19 August, to which
you attached a copy of a letter from the United Statos Embassy
concerning the remarks which the Minister of National Defence
is reported to havo raade at his press conference on 1 August,
concerning Canadian legislation which would prohibit the storage
of nuclear weapon components in Canada.

2.
I would suggest that in the reply to the United States
Embassy you might draw to their attention the Atomic Energy
Control Act R.S.C. 1952, ell and the Atomic Energy Control
Regulations, para. 201, which states:
"No person shall import into Canada or export from
Canada any., proscribed equipment for the time being
specified by order for the purposes of this section or
any prescribed substance without first producing to
the Collector of Customs and Excise at th© proposed
port of entry or exit an import or export permit from
the Board, and no Collector of Customs and Excise
shall permit any ouch prescribed equipment or any
prescribed substance
(a)

to be released for delivery to an importer in
Canada; or

(b) to be exported froa Canada,
unless the appropriate permit from the Board is
produced to him".
3.
It would also be in order to inform the United States
authorities that the Department of National Defence are ascertaining what changes in the Atomic Energy Control Act or the
Customs Act of Canada will be required to allow the following
conditions, which were laid down in para. 6 of my letter of
9 August to the Judge Advocate-General;
(a)

the free importation and exportation of nuclear
weapons or components for the purposes of the
defence of Canada;
(b) the free import, export and passage through Canadian
air space of nuclear weapons of the members of the
North Atlantic Treaty Organization or other military
alliances which may be entered into by the Canadian
Government;
(c)

the storage on Canadian territory of nuclear weapons
and compondnts for the use of Canadian or NATO
forces or whero the ownership in peacetime is vested
in another MATO partner; and

(d)

the use of nuclear weapons in Canadian air space by
tho United Statos air defonee forces under conditions
of impending or apprehended attack on North America.

4.
It is not expected that these proposed changes in
legislation will be introduced by the Government in the next
session but those preparations are boing made to bo ready
to introduce thio legislation into somo future session of
Parliament•
