With r e f e r e n c e t o your l e t t e r of 19 August, t o wliich
you a t t a c h e d a copy of a l e t t e r from the United States E m b a s s y
concerning the r e m a r k s which the Minister of National Defence
is r e p o r t e d to have made a t his p r e s s conference on 1 August,
concerning Canadian legislation which would prohibit the s t o r a g e
of n u c l e a r weapon components in Canada.
2.
,1 would suggest that in the reply to the United States
E m b a s s y you might draw t o t h e i r attention the Atomic Energy
Control Act R . S . C . 1952, c . 11 and the Atomic Energy Control
Regulations, p a r a . 2 0 1 , which s t a t e s :
"No p e r s o n shall i m p o r t into Canada or e x p o r t from
Canada any p r e s c r i b e d equipment for the t i m e being
specified by o r d e r for the p u r p o s e s of t h i s section or
any p r e s c r i b e d substance without f i r s t producing t o
the Collector of Customs and E x c i s e a t the p r o p o s e d
p o r t of entry o r exit an i m p o r t or export p e r m i t from
the B o a r d , and no Collector of Customs and Elxcise
shall p e r m i t any such p r e s c r i b e d equipment or any
p r e s c r i b e d substance

(a) to be r e l e a s e d for delivery t o an i m p o r t e r in
Canada; or
(b) t o b e exported from, Canada,
u n l e s s the a p p r o p r i a t e p e r m i t from the B o a r d i s
produced to h i m . "
3.
It would also be in o r d e r to inform the United States
a u t h o r i t i e s t h a t the D e p a r t m e n t of National Defence a r e a s c e r taining what changes in the Atomic E n e r g y Control A c t o r the
C u s t o m s Act of Canada will be r e q u i r e d t o allow the following
conditions, which w e r e laid down in p a r a . 6 of my l e t t e r of
9 August t o the Judge A d v o c a t e - G e n e r a l :
(a)

the free i m p o r t a t i o n and exportation of n u c l e a r
weapons o r components for the p u r p o s e s of the .
defence of Canada;

(b)

the free i m p o r t , export and p a s s a g e through Canadian
a i r space of n u c l e a r weapons of the m e m b e r s of the
North Atlantic T r e a t y Organization or other m i l i t a r y
a l l i a n c e s which may be e n t e r e d into by the Canadian
Government;

(c)

the storage on Canadian t e r r i t o r y of n u c l e a r weapons
and components for the use of Canadian or NATO
forces or where the ownership in p e a c e t i m e is v e s t e d
in another NATO p a r t n e r ; and

(d)

the use of n u c l e a r weapons in Canadian a i r space by
the United States a i r defence forces under conditions
of impending or apprehended attack on North A m e r i c a .

4.
It i s not expected that t h e s e p r o p o s e d changes in
legislation will be introduced by the Government in the next
s e s s i o n but t h e s e p r e p a r a t i o n s a r e being made to be ready
to introduce t h i s legislation into some future s e s s i o n of
Parliament.
