In reading through the aims for which legislative amendments are to be prepared (paragraph 6 of the letter from the CCOS), two thoughts occur to this Division. First, it appears that the legislation is designed to give the Minister of National Defence the authority to make the appropriate orders and regulations on this subject. While this is reasonable in the final analysis, we wonder if some provision for prior consultation with this Department in each case should not also be included so as to protect our interests. Second, it might be advisable to ensure that all references to movement and storage of nuclear weapons should refer to weapons of "NATO forces" rather than weapons of "the members of the North Atlantic Treaty Organization or other military alliances which may be entered into by the Canadian Government", as is the case in point (b) of paragraph 6 of the letter. If this is not done, the national forces of NATO members not under A0027625 46-000203 �TOP SECRET - 2* ..1 . 7.? l^^ NATO command would be covered, and, if at a later date such forces possessed nuclear weapons, some undesirable political complications could arise. In this connection, the seouiid" provision in point'"(c) of paragraph 6 dealing with the storage of nuclear weapons "where the ownership in peacetime is vested in another NATO partner" is perhaps also broader than is necessary.
