I.
Further to our conversation of today's date
gar ding the drafting of amendm nts to certain Acts of
Parliament governing th importation, exportation, use and
control of nuclear weapons and components on Canadian
soil and in Canadian air space.

You w i l l recall that arrangements were made
under PC 2307 of 17 April, 1952, which provided for c ertain
flights of the United States Air Force in Canadian air space
with authority to land at Canadian b a s 3 » , carrying nuclear
m a t e r i a l s . These regulations have been in force for the past
five y e a r s aad have been used to clear flights of the United
States Strategical Mr Force carrying nuclear material. A s
these aircraft have not had occasion t o land to Canadian
territory the question of the applications of the Atomic
Energy Act of Canada and the Customs Act of Canada has
not a r i s e n . However we may get into difficulties should one
of the aircraft of the U . S . Strategical Air Force be required
to land during one of these flights, especially if no previous
arrangements have been made for clearance with the Atomic
Energy Control Board and with the Department of National
anue (Customs Division).

You will also recall that under PC 1957-240
of 21 February, 1957, arrangements were m a l e for the
overflight and the landing of United Kingdom aircraft
transporting nuclear components in connection with Exercise
GRAPPLE. Thes a flights were cleared by means of the
temporary expedient whereby the President of the Atomic
Energy Control Board issued a blank permit and the Deputy
Minister of Customs end Excise grante authority for the
clearance of these aircraft without examination.

You w i l l a l s o recall that there were exchanges
of notes between the United States and Canadian Governments
on 19 ebruary and 28 June, 1957 (copies attached) which
authorized the United States Air Force under certain conditions
to fly in Canadian air space carrying atomic weapons and
which outlined arrangements for the salvage of aay MB. 1
