(a)

Articles 20 and 21 of the 1957 Communique provide:
"To this end, N A T O has decided to establish stocks
of nuclear warheads, which will be readily available
for the defence of the Alliance in case of need.
In view of the present Soviet policies in the field
of new weapons, the Council has also decided that
intermediate-range ballistic missiles will have to
be put at the disposal of the Supreme Allied Commander

Europe.

The deployment of these stocks and missiles and
arrangements for their use will accordingly be
decided in conformity with NATO defence plans and in
agreement with the states directly concerned. The
NATO military authorities have been requested to
submit to the Council at an early date their recommendations on the introduction of these weapons in

will consider the various questions involved."
This reference was included in the version of the Canadian
composite draft which was approved by the Panel on the Economic
Aspects of Defence Questions (Panel). It would seem to be
relevant to an agreement relating to forces in Europe. rfhile
not strictly relevant there seems to be no objection to
Including it In an agreement for forces attached to NORAD,
particularly if the Government should wish to assert a
relationship between 1I0RAD and NATO.

(c) The reference to prior "agreement in principle" is
carried into the Canadian draft approved by the Panel but
not in the latest Canadian draft. It could be retained.

imply a much more comprehensive involvement. The need to
amend the United States provision does not seem to be

Inclusion of a reference to "custody" was approved by
the Panel, viz., "the custody will be the responsibility of
the United States". United States responsibility for
custody is understood to be required by the United States
Atomic Energy Act.

In the latest Canadian draft "joint responsibility"
was -sought to be acnieved by omitting reference to United
States responsibility for custody and developing the concept
of responsibility for inner and outer security. Canadian
responsibility for external security is conceded in
paragraph 6 of the United States agreement. The U.S. draft
conforms to the NATO Nuclear Stockpile concept which defines
"custody" as control of access to nuclear weapons and makes
this a United States responsibility and "security" as
protection against hostile elements of any nature and makes
this the responsibility of the potential user nation. He
could ask that Article 3 of the Canadian draft be inserted
after Article 3 of the United States draft with a consequent
modification of United States Article 6, but it is considered
that such an addition is unnecessary if we concede United
States responsibility for custody as defined.
The Canadian draft specifies that United States personnel
be provided "in the minimum numbers required". This statement
conforms to the NATO concept and should be incorporated in
any NORAD agreement.
Some of the additional provisions for custody in respect
of RCAF interceptors- on strip alert set out in Article 4(b)(1)
were designed for a specific stand-by arrangement no longer
applicable, others appear to have continuing validity and
could usefully be retained.

COMMENTS

The United States draft Article begs the question of
control over release for use and use, or assumes that it
will be defined elsewhere. From the United States point
of view the provision stems no doubt from the United States
requirement for Presidential authority to release nuclear
weapons for use. From the Canadian point of view, control
over release for use and use (if these are not the same
decision) has to bs stipulated in an Inter-governmental
agreement except where there may be said to be constructive
inter-governmental agreement for instance through the
Instrumentality of the NATO Council. That is, it is
arguable that such agreement already exists within the
NATO framework, where the procedure for release for use is
understood to require Presidential authority plus authority
of the country which will be using the weapons. This being
so the provision of the United States draft on NHTO would
suffice, In the light of agreed NATO procedures in the form
of the Athens guide lines.
In the case of Naval forces earmarked for SACLANT, it
will be for consideration whether Canadian Government's
agreement to assignment of forces to SACLANT carries with
it authority to use nuclear weapons if necessary. Assignment would require to be considered at the Reinforced Aler
stage or under MARCOM (Maritime Contingent plans vis-k-vl;
ert
Berlin) at Simple Alert. (See comment under Article 7 re
release from shore storage to ship-board storage.)

So far as NORAD Is concerned responsibility for release
for use and (if there can realistically be any distinction)
for use requires to be elaborated. If the consultative
procedures under NORAD and on Alerts are observed, there
might already have been ample consultation between Canada
and the United States prior to Presidential release to

Previous drafts have specified United States responsibility
for moving warheads "to Canada and from Canada" because it was
not certain whether United States responsibility would end at
the border or at the storage site. - The latest Jnited States
draft is no clearer, though precision on this point is
probably not necessary in a general agreement. According to
the NATO concept the warheads are flown to airports near
storage sites. There should be a proviso "in conformity
with applicable Canadian laws and regulations".
The Canadian draft (Article 4) provides that release
of the weapons from storage to meet logistic purposes
' required "inter-governmental consultation". This presumably
refers to release for return to United States for maintenance
purposes. The requirement was apparently intended to underline the principle of joint responsibility and is not
necessary for that purpose. On the other hand, it would
give some assurance of the adequacy of current levels of
stocks of warheads in Canada. It is for consideration whether
a proviso should be added to Article 7 of the United States
NORAD draft along the following lines:
"Substantial variation in the levels of stocks
of weapons/warheads available to Canadian
forces shall be subject to inter-governmental
consultation."

Article (8)
The United States draft places the responsibility on
Canada to provide the necessar/ communications. The
Canadian draft leaves this point open to agreement
between the appropriate authorities. The general agreement
should specify financial responsibility. The meaning of
the exception to the United States Article is not clear
since there would seem to be no alternative to a "reliable
means of signals communications" unless some other form
of communications would suffice. It Is suggested that
Canada might assume responsibility for the establishment
and maintenance of communications with responsibility for
operation being the subject of agreement between the
appropriate authorities.

Article (10;
The United States draft is substantially the same as
the last two sentences of Article o of the Canadian draft.
To meet the requirement that procedures be "subject to
the agreement of Canada" it is suggested the U.S. Article
be revised to read "will be subject to agreement between
the appropriate authorities". This is not restricted to
military authorities as in the U.S. draft, against the
event that officials oi' the Atomic Energy Control Board
were to have an Interest in this aspect.
The reason for the first sentance of Article 3 of the
Canadian draft is not clear. The statement is obvious . &gt;•
