RAE: Overflight Arrangements FEB 2 1 1985 THE SO-CALLED MB-1 AGREEMENT Under this Agreement United States Air Force interceptors, under the operational control of NORAD, are authorized to carry nuclear air-to-air defence weapons over Canadian territory. The present Agreement expires on June 30, 196l at which time we have agreed to review it. Under the Agreement United States interceptors armed with nuclear weapons may enter Canadian air space whenever a condition of air defence readiness or i higher state of alert is declared by CINC NORAD. The aircraft may land or take off from military air fields in Canada. Additionally there are other provisions regarding rules for interception and engagement, precautions to be taken to avoid public hazards, the training of RCAF personnel to handle accidents and consultation on the release of information. "STRATEGIC AIR COMMAND BOMBERS AND STRATEGIC AIR COMMAND TRANSPORT AIRCRAFT" 2. The procedures governing these flights are laid down by Order-inCouncil P.C.2307 of April 1?, 1952. The particular provisions, i.e. Schedule "B" of this Order-in-Council^were revised on July 8, I960. The present practice, insofar as training flights are concerned, is for the Canadian Government to approve a programme of such flights over a period of approximately three months. Individual flights within this period are cleared between the Chiefs of Air Staff of the two countries. The procedures laid down also provide for clearance of Strategic Air Command transport aircraft flights and of course actual operational flights. 3. During the negotiation of revised procedures for SAC aircraft, the United States was anxious to have the procedure' cover all United States military aircraft so as to facilitate programming of nuclear resupply overflights for military organizations other than SAG. The idea was to obtain prior approval covering a period of three or four months and then route resupply aircraft across Canada as might be necessary from time to time. The Canadian Government was not prepared to broaden the category of aircraft covered by Schedule "B". The State Department was informed that any flights not covered by Schedule "Bn (e.g. overflights of military transport aircraft delivering nuclear warheads to United States forces, other than SAC, in Europe or in connection with the NATO programme) should be submitted to the Canadian Government through the diplomatic channel as special cases for its consideration as in the past. Regulations 1. These regulations may be cited as the Regulations Governing Flights of United States Service Aircraft over Canadian Territory, 1952. 2. Aircraft belonging to the United States of America and operated by the United States armed services or the Department of Defence of the United States may, on a reciprocal basis and subject to these regulations and in compliance with orders and directions issued by the Minister of National Defence, fly in or over, land in and take off from Canada and the territorial waters thereof. 3. Subject to such exceptions and conditions as may be prescribed by the Minister of National Defence, the flight of aircraft mentioned in section two over areas that have been or may be prescribed as prohibited or restricted areas by or with the approval of the Governor in Council and such other areas as are designated by the minister is prohibited. 4. Unless the Minister of National Defence otherwise directs, aircraft mentioned in section two in or over Canada and the territorial waters thereof are subject to the same rules and regulations for the safe and proper operation of aircraft in Canada as apply to Canadian service aircraft and are under the control of the same agencies as are Canadian service aircraft. Nothing in this Schedule relates to overflights by interceptors armed with nuclear rockets, which are covered by other arrangements. TYPE OF FLIGHT CHANNEL OF COMMUNICATION AND CLEARING AUTHORITY Y Flights carrying nuclear weapons or nuclear components thereof which are undertaken as part of routine deployments, stockpiling, increasing readiness posture or ..-emergency dispersal of nuclear weapons, using bases in Canada and/or overflying Canadian Territory. This category includes bomber or transport aircraft carrying nuclear weapons. The programme of each series of overflights and individual overflights not part of a series previously approved, will be cleared at governmental level through diplomatic channels. Details of individual flights and any modifications and contingency requirements not included in the flight programme will be cleared in advance between the Chiefs of Air Staff. Each of these flights will require to be authorized by the Minister of National Defence in accordance with the regulations laid down in Order-in-Council P.C. 2307 of April 17, 1952 Z Flights carrying nuclear weapons or nuclear components thereof and engaged on strikes or deployments for strikes using bases in Canada or overflying Canadian Territory. This category covers the case where an immediate strike is contemplated. Government-Government (State Department-External Affairs). At the earliest possible indication of such a requirement, a request will be submitted through previously arranged channels to allow expeditious action by Canada. 000321 �Document disclosed underthe Access to Information Act Document divulgue en vertu de la Loi sur l'acces a I'information DRAFT No. The Ambassador of Canada presents his compliments to the Secretary of State and has the honour to refer to the Secretary's Note of June 3 seeking approval in principle of the Canadian Government for a series of overflights of Canadian territory by aircraft of the Strategic Air Command carrying atomic weapons, from July 1 to September 30, 1963 and for confirmation of the approval of amplified emergency procedures ■ for aircraft engaged in Operation "Chrome Dome" as communicated in the Embassy's Note No. 22 of Jan.- 14, 1963. The Canadian Government has considered this request and is prepared in future to extend the period for which approval in principle is required to be sought inter-governmentally to six months. Consequently the Canadian Government is prepared to give its approval in principle for the continuance of the overflights undertaken as part of the series of training exercises designed to develop an emergency alert capability, for the period July 1, 1963 to December 31, 1963, it being understood that clearance for individual flights will be arranged as heretofore on a service-to-service basis. It is noted that? in carrying out this programme of overflights the United States will take into account the views of the Canadian Government as set out in previous correspondence.
